Unsafe Work Equipment

A recent case shows that by going out of your way to prohibit the use of ‘dodgy’ equipment, you may, contrary to your intention, increase potential liability.

Jonathon Toner (T) was an experienced roofer who was being employed on a casual basis to carry out some minor works on the roof. The work was under the control of George Morrison (GM). When T arrived on site he found that there was already a ladder positioned on the roof. Somewhat inevitably, the makeshift roof ladder fell apart and T fell to the ground. He sued GM for damages.

GM claimed that he wasn’t liable because the ladder had not been provided for the use of anyone except himself. He claimed that he had clearly instructed all those working on the site that they should not use the ladder. The court was asked to consider the issue of liability. This states that work equipment should be suitable for its purpose. The regulation applies to anyone who has control over work equipment or the way it is used.

If you know that work equipment being used on your site is potentially unsafe, don’t just ban it, get rid of it. As this case proves, simply telling workers not to use it does not satisfy your legal duties.
